These Terms and Conditions govern the use of NeoFresh services, website, delivery communication, purchase transactions and all exchanges between NeoFresh and customers. By browsing, ordering or interacting with NeoFresh, you acknowledge that you have understood these terms, and you voluntarily agree to follow them exactly as stated. NeoFresh is the Fruits, Vegetables and Fresh Produce division of Farmnova Dairytech Private Limited and provides household delivery of farm sourced produce, freshly procured marketplace produce and other consumable items. NeoFresh may revise service coverage, delivery schedule and product range as it evolves, but all service shall continue to operate under these Terms and Conditions.
We, Us, Company refer to Farmnova Dairytech Private Limited operating its produce division as NeoFresh. You, User, Customer refer to the person who visits NeoFresh website, creates account, places order, receives goods, or interacts with NeoFresh support.
Order means any request raised by customer for supply of produce with expectation of delivery within selected slot.
Delivery Slot means scheduled morning or evening period within which delivery team attempts to reach customer.
Invoice means electronically generated document confirming product supply, quantity and value.
Service Interaction means phone call, email, message, doorstep conversation or app-based acknowledgement relating to order fulfilment.
These meanings apply uniformly throughout the Terms.NeoFresh may update Terms without separate notice. Updated terms shall apply automatically. Customer acknowledges that continued usage means acceptance.
When you create an account or submit order, you provide information voluntarily. You must ensure correctness of your name, phone number, delivery address, block identification, floor number and gate entry instructions.
If an order fails due to incorrect address or unreachable phone, NeoFresh shall not carry liability for delay or loss.
Customer agrees that post-delivery modification such as relocation to different building cannot be applied backward to earlier order.
Customer must keep credentials private. If you share credentials with other individuals, NeoFresh cannot prevent misuse.
NeoFresh reserves the right to deactivate account if inaccurate information is repeatedly submitted or if behaviour causes disruption in delivery chain.
Your order is considered accepted when system displays confirmation and invoice initiation begins. NeoFresh reserves right to modify order if products become unavailable, damaged during handling, or unsuitable for dispatch. Unavailable items will be removed and value of such removal shall be refunded or adjusted.
Delivery is carried during applicable slots. If customer is unreachable for extended time or rejects delivery access, order may be handed to building security or authorised receiver. Such delivery shall be treated valid. Once delivery agent leaves premises after handover, customer cannot later contest condition unless recorded at time of handover.
If customer rejects delivery three times in one calendar month without valid reason, NeoFresh may suspend service temporarily or permanently.
Products like fruits and vegetables may show minor weight variation due to natural size differences. Invoice value therefore reflects final exact weight billed. Product displayed on website may carry approximate weight. Customer accepts final value recorded on invoice as accurate representation of transaction.
Market-based price fluctuation occurs frequently. NeoFresh may update price when receiving product from source market. Customer accepts that displayed price may be updated to reflect sourcing cost.
Price charged shall never exceed posted value unfairly. NeoFresh follows open rate. Price transparency forms part of commitment.
Customer may choose cash, digital payment, card payment or wallet settlement.
Digital payment confirmation is received from gateway. If payment fails during transaction, customer must retry.
If customer selects cash payment at doorstep, full amount must be provided before goods are accepted.
Customer acknowledges that refusal to tender payment after accepting goods constitutes breach of terms.
Since products are perishable, returns can occur only at time of delivery and only if defect is visible or quantity is incorrect.
Replacement or refund must be recorded through delivery agent or written message to support immediately.
Refund when approved shall be processed using the same mode originally used for payment unless otherwise communicated.
Repeated false claims or repeated rejection of goods without reason shall invite account review.
Refund shall not apply for deterioration caused after customer accepted goods and stored in unsuitable conditions.
NeoFresh expects respectful behaviour between customers and service representatives. Abuse, harassment, threatening language, or derogatory tone is unacceptable.
NeoFresh may restrict service access if behaviour causes operational discomfort.
NeoFresh operates under governance that includes women directors. Company values dignity of staff members and expects same from customers.
Any offensive language shall result into review of account and possible suspension.
Customer acknowledges that NeoFresh maintains digital records of orders, delivery timestamps, complaint messages and refund actions. These records become basis for resolution in dispute.
Customer agrees that verbal recollection cannot override timestamp and invoice record.
Customer can request record only after identity verification.
NeoFresh uses recorded transaction history strictly for service clarity and not for unrelated advertisement.
NeoFresh may send promotional messages or seasonal offers. Customer may request discontinuation anytime in writing or by informing support number.
After such request, promotional alerts shall discontinue while genuine transactional messages remain active.
Transactional messages cannot stop because these relate to delivery, invoice and refund.
Cancellation is allowed before dispatch. If customer cancels after dispatch but before arrival, cancellation fee may apply based on logistics already incurred.
Cancellation is not accepted after goods are examined and accepted by customer or by authorised family member.
NeoFresh may cancel order if supply is unavailable, quality is compromised or adverse condition prevents delivery.
Refund in such situation shall be processed promptly.
Customer may also request termination voluntarily.
Records remain preserved due to legal requirement.
Product representation such as image, colour, shape or produce cut may vary from actual due to natural variation. NeoFresh does not guarantee identical visual representation.
Technical error in stock display or price display may occur. NeoFresh reserves right to rectify such error.
Customer cannot demand compensation solely because website representation differed visually from natural produce.
NeoFresh responsibility concludes when order is handed over properly. Once goods leave custody, responsibility of storage belongs to customer. NeoFresh cannot assume liability for deterioration due to improper storage.
NeoFresh is not liable for losses caused by circumstances outside control such as weather delay, movement restriction, building entry refusal or emergency closure imposed by administration.
Company may update these Terms anytime to comply with law or operational change. Continued use means acceptance. Customer agrees to review Terms periodically.
All matters arising from these Terms shall come under exclusive jurisdiction of competent courts located in Bokaro Jharkhand where Farmnova Dairytech Private Limited is registered.
